What is a Power of Attorney in Pakistan?
A Power of Attorney (POA) is a legal document under the Power of Attorney Act 1882 that authorises another person โ the "attorney" โ to act on your behalf for specified legal, financial, or administrative matters in Pakistan. For overseas Pakistanis, a POA is the single most important document because it enables you to manage affairs in Pakistan without being physically present.
Every remote legal service we provide โ from NADRA document collection to court appearances for divorce or property disputes โ relies on a valid Power of Attorney.
General vs Special Power of Attorney
General Power of Attorney (GPA) gives your attorney broad authority to act on all matters on your behalf. This is powerful but risky โ a GPA holder can conduct any transaction in your name. We generally advise against GPAs for overseas clients unless absolutely necessary.
Special Power of Attorney (SPA) limits authority to specific tasks โ for example, selling a particular property, appearing in a specific court case, or collecting a specific NADRA certificate. We recommend SPAs for most overseas Pakistani clients because they provide protection against misuse.
How to Execute a POA from Abroad
The process depends on your country of residence:
Power of Attorney from the UK
The UK has the highest demand for Pakistan POA services, reflecting the massive British Pakistani community's property and legal ties to Pakistan, particularly to Mirpur AJK.
- We draft the POA document according to Pakistani law requirements
- You sign the POA at the Pakistan High Commission London (35-36 Lowndes Square) or at a UK solicitor/notary
- If signed before a UK notary, the document must be legalised by the FCO and then attested by the Pakistan High Commission
- We register the POA with the Sub-Registrar in Pakistan
Power of Attorney from the USA
- We draft the POA
- You sign before a US Notary Public
- The document is apostilled by your state's Secretary of State (USA is a Hague Convention member)
- The apostilled POA is then attested at the Pakistan Embassy or Consulate
- We register it in Pakistan
Power of Attorney from the UAE
- We draft the POA
- You sign at the Pakistan Consulate Dubai or Embassy Abu Dhabi
- Direct attestation at the same visit
- We register in Pakistan
Power of Attorney from Canada
- We draft the POA
- You sign before a Canadian Notary Public
- The document is authenticated and legalised through Global Affairs Canada
- Attested at the Pakistan High Commission Ottawa or consulates
POA for Property Transactions
Property-related POAs are our most common type. Whether you need to sell property, buy property, file a property dispute case, manage rental property, or handle succession and inheritance matters, a Special POA authorising your attorney for the specific transaction is essential.
For property sales, the POA must specifically mention the property details (address, khasra number, khata number) and authorise the attorney to execute the sale deed, receive payment, and complete registration at the Sub-Registrar office.
POA for Court Appearances
If you have an ongoing court case in Pakistan โ whether family law, property, or civil โ your lawyer needs a POA to appear and plead on your behalf. This is particularly common for overseas Pakistanis involved in divorce proceedings, child custody matters, or property litigation.
How Long is a POA Valid?
A POA remains valid until: - The principal (you) revokes it in writing - The specified task is completed (for Special POA) - The expiry date stated in the POA passes - The principal dies
We recommend including an expiry date in every POA for security. For ongoing matters, a 2-year validity with the option to renew is standard practice.
Cost and Timeline
POA drafting typically takes 1โ2 business days. Embassy attestation depends on your local embassy's processing time โ usually same-day or next-day. Registration in Pakistan takes 3โ5 business days after we receive the attested document.
