What is an Affidavit Under Pakistani Law?
An affidavit is a written sworn statement made voluntarily under oath, used as evidence or declaration for legal, administrative, or official purposes. In Pakistan, affidavits are governed by the Oaths Act 1873 and must be notarised by a licensed Notary Public or attested by a Magistrate to have legal validity.
For overseas Pakistanis, affidavits are needed surprisingly often โ from NICOP renewal (when there are name discrepancies) to property transactions, immigration applications, and court proceedings. We prepare and notarise affidavits remotely for clients worldwide.
Common Types of Affidavits for Overseas Pakistanis
Name Change Affidavit Used when your name on Pakistani documents differs from your international documents โ common after marriage, or when transliteration from Urdu to English creates variations. Essential for NADRA corrections.
Bachelorhood / Unmarried Status Affidavit Required for nikah applications, visa applications, and immigration processes. Declares that you are unmarried and free to enter into marriage.
Income Affidavit Used in court proceedings โ particularly maintenance (nafqa) and divorce cases โ to declare income for the purpose of maintenance calculations.
Heirship Affidavit Declares the legal heirs of a deceased person. Used alongside applications for succession certificates and legal heir certificates.
General Purpose / Custom Affidavit Any sworn statement for a specific legal purpose. We draft custom affidavits for property declarations, lost document declarations, relationship declarations, and any other purpose required by courts, NADRA, or government agencies.
How the Process Works for Overseas Pakistanis
Our affidavit service works entirely remotely:
- Tell us the purpose โ describe why you need the affidavit and provide relevant details
- We draft โ our lawyers draft the affidavit in the legally required format under Pakistani law
- Review โ you review the draft and approve or request changes
- Notarisation โ the affidavit is notarised by a licensed Notary Public in Pakistan
- Delivery โ the original notarised affidavit is couriered to your international address
For some purposes, you may need to sign the affidavit yourself at your local Pakistan Embassy or before a local notary with apostille. We advise on which route is required for your specific purpose.
Attestation and International Use
A Pakistan-notarised affidavit is valid within Pakistan. For international use, the affidavit may need additional attestation:
- MOFA attestation โ for use in countries that require Ministry of Foreign Affairs attestation
- Embassy attestation โ some countries require attestation by their own embassy in Pakistan
- Apostille โ Pakistan is not yet a member of the Hague Apostille Convention, so the traditional legalisation chain applies
We handle the complete attestation chain as part of our service.
