Why Property Disputes Affect Overseas Pakistanis Disproportionately
Overseas Pakistanis are disproportionately affected by property disputes precisely because they are not physically present in Pakistan to monitor and protect their assets. Unscrupulous relatives, neighbours, or even strangers take advantage of the owner's absence to illegally occupy land, forge documents, or encroach on boundaries.
The problem is particularly acute for British Pakistanis with property in Mirpur AJK, where Mangla Dam displacement created complex, overlapping land titles that remain disputed generations later.
Common Types of Property Disputes
Illegal Occupation (Qabza) Someone has taken physical possession of your property without legal authority. This is alarmingly common โ a relative, tenant, or complete stranger may move onto your land while you are abroad. Under the Illegal Dispossession Act 2005, illegal occupation is a criminal offence punishable by imprisonment.
Fraudulent Sale A family member or authorised person has sold your property or part of it without your consent or beyond the scope of their authority. This typically involves forged Power of Attorney documents or fraudulent sale deeds at the Sub-Registrar office.
Inheritance Disputes After a parent or relative's death, disputes arise over who inherits what. Under Islamic law (Faraid), shares are predetermined โ but in practice, disputes are common when one heir denies another's share or refuses to cooperate in obtaining a succession certificate.
Boundary Disputes Adjacent property owners encroach on your land. This requires a survey, revenue record verification, and potentially a civil suit for demarcation.
Your Legal Options
1. Legal Notice The first step is usually a formal legal notice under Section 80 of the Civil Procedure Code 1908. This puts the other party on notice of your claim and often resolves disputes without court proceedings.
2. Civil Suit for Possession If the dispute cannot be resolved through notice, we file a suit for possession and/or injunction in the relevant civil court. An injunction prevents the opposing party from further damaging or disposing of the property while the case is pending.
3. Criminal Complaint For illegal occupation, we can file a criminal complaint under the Illegal Dispossession Act 2005 at the local police station. This carries penalties of up to 3 years imprisonment and creates additional pressure for resolution.
4. Revenue Record Correction If someone has tampered with the revenue records (Fard, Jamabandi), we apply for correction at the Revenue Department and, if needed, appeal to the Commissioner or Board of Revenue.
How We Handle Property Disputes Remotely
Every property dispute case we handle follows this pattern:
- Case review โ you share property documents via WhatsApp and we assess the situation
- Power of Attorney โ essential for court appearances and legal filings
- Legal notice โ formal notice to the opposing party
- Court filing โ if notice doesn't resolve the matter
- Litigation management โ we attend all hearings, file evidence, and negotiate on your behalf
We handle cases across all Pakistani courts, including the separate jurisdiction of AJK High Court for Mirpur and Kashmir properties, the Lahore High Court, and district courts in Karachi, Islamabad, and beyond.
The Mirpur AJK Special Case
Property disputes in Mirpur deserve special mention. The AJK region has a separate legal system from Pakistan's provinces, with the AJK Supreme Court and AJK High Court operating independently. The Mangla Dam displacement in 1966 created a unique category of land title disputes involving rehabilitation claims, compensation lands, and displaced persons' rights.
British Pakistanis from Birmingham, Bradford, and Leeds are the most affected community. We have extensive experience with AJK property law and the Mirpur revenue system.
Preventing Property Disputes
The best approach is prevention:
- Register your property with the relevant authority and keep documents updated
- Execute a reliable Power of Attorney for a trusted family member or lawyer
- Conduct periodic title verification through the revenue office
- Keep copies of all property documents digitally
